Get Work Permit in Thailand

Application Process

Step 1: Possessing Non-Immigrant Visa

A valid Non-Immigrant Visa, which a foreigner can apply for at a Thai Embassy overseas before to arriving to Thailand, is required for getting a Thai work visa. Alternatively, a current tourist visa can be converted to a non-immigrant visa at the Immigration Office in Bangkok without leaving Thailand.

In most circumstances, the non-immigrant visa will be a type B – business visa – however a type O – marriage visa – can serve for foreigners married to Thai nationals.

It should be mentioned that some countries and embassies demand a pre-approval letter from the Labour Department before accepting visa application paperwork. This pre-approval letter would act as confirmation from your Thai employer/business that you would be traveling to Thailand to work for that specific company.

Step 2: Obtaining Thai Work Permit

The Labour Department is in charge of granting work permits to foreigners in Thailand. A corporation that applies for a work visa to support each of its foreign directors and/or employees must fulfill specific requirements. In addition to the necessity for VAT registration at the Revenue Department, the firm must also meet the requirements listed below to support each work permit.

Capital of the company that should be registered as paid up:

  • 2 million THB capital for a Thai limited company
  • 1 million THB capital to support a foreigner married to a Thai national
  • 3 million THB capital for a foreign company

Number of Thai employees that should be registered for Social Security Funds:

  • 4 Thai employees for a Thai limited company or a foreign company registered in Thailand
  • 2 Thai employees in the case of the foreigner is married to a Thai national
  • 1 Thai employee for a foreign company registered as a branch or representative office in Thailand

Once the relevant prerequisites are completed and the firm has the appropriate paperwork to demonstrate compliance with legal, tax, and accounting rules, the company will be ready to assist the foreigner’s work permit application. It should be mentioned that, unlike in some other countries, the work permit in Thailand cannot be given on its own. Prior to applying, the foreigner must have a permanent employment and must work solely in the firm, scope, position, and address specified in the work permit booklet. In his work permit booklet, a foreigner may indicate more than one position, residence, or company/employer.

Step 3: Application Approval

Once filed, the application is reviewed within 7 to 10 business days, following which the foreigner must personally present at the Labour Department office to get the work permit booklet. The work permit is generally valid for one year, but it may be issued for a shorter period of time, such as six or three months, depending on a number of factors, including but not limited to the applicant’s nationality, the fact that the company is new, and/or the validity of the applicant’s passport. It should so be renewed as needed to allow the foreigner to stay.

Responsibilities After Obtaining a Work Permit

Tax ID & Annual Income Tax Filing

The company’s responsibilities do not end with acquiring the work permit. Once the foreign director or employee has a work visa and is legally permitted to operate in Thailand, they must receive a Tax Identification Card from the Revenue Department through the firm. This card has a tax identification number, or tax ID, that will be used on an annual basis for withholding tax and personal tax returns. How to do Work Permit Renewal

When the validity of a foreign director’s or employee’s work permit is due to expire, it can be extended. This can be done at the Labour Department where the original work permit was obtained. The non-immigrant visa must be valid or renewed before the work permit may be renewed.

About the Work Permit Cancellation

Foreigners who quit or are fired from their jobs must have their work permits withdrawn at the Labour Department within 10 days of the foreigner’s final working day.
